The Gauteng High Court in Pretoria has dismissed former public protector Busisiwe Mkhwebane’s application to force the Office of the Public Protector to pay her R10 million gratuity.
Mkhwebane launched the court bid saying the gratuity formed part of her remuneration package and she is entitled to it.

As the head of a Chapter Nine institution, Mkhwebane definitely raked in the big bucks. She earned R2.3 million annually and enjoyed some perks with came with the cushy gig.
Despite fighting tooth and nail to keep her job, eventually she was impeached in September 2023 after a total of 318 MPs voted in support of the motion to remove Mkhwebane, while 43 others were against the move. Her impeachment meant she essentially forfeited the multimillion rand gratuity that would have been due to her had she completed her tenure at the Office of the Public Protector without any hinderance.
Mkhwebane’s legal representative advocate Dali Mpofu had argued that she was entitled to the gratuity payment, and the fact that the parliamentary inquiry made findings against her, had nothing to do with her right to this payment, Independent Online reported.
